We implemented a user-centered approach to the design of an artificial intelligence (AI) system that provides users with access to information about the workings of the United States federal court system regardless of their technical background. Presently, most of the records associated with the federal judiciary are provided through a federal system that does not support exploration aimed at discovering systematic patterns about court activities. In addition, many users lack the data analytical skills necessary to conduct their own analyses and (...) convert data into information. We conducted interviews, observations, and surveys to uncover the needs of our users and discuss the development of an intuitive platform informed from these needs that makes it possible for legal scholars, lawyers, and journalists to discover answers to more advanced questions about the federal court system. We report on results from usability testing and discuss design implications for AI and law practitioners and researchers. (shrink)

ABSTRACT:A wide range of research uses patterns of genetic variation to infer genetic similarity between individuals, typically referred to as genetic ancestry. This research includes inference of human demographic history, understanding the genetic architecture of traits, and predicting disease risk. Researchers are not just structuring an intellectual inquiry when using genetic ancestry, they are also creating analytical frameworks with broader societal ramifications. This essay presents an ethics framework in the spirit of virtue ethics for these researchers: rather than focus on (...) rule following, the framework is designed to build researchers’ capacities to react to the ethical dimensions of their work. The authors identify one overarching principle of intellectual freedom and responsibility, noting that freedom in all its guises comes with responsibility, and they identify and define four principles that collectively uphold researchers’ intellectual responsibility: truthfulness, justice and fairness, anti-racism, and public beneficence. Researchers should bring their practices into alignment with these principles, and to aid this, the authors name three common ways research practices infringe these principles, suggest a step-by-step process for aligning research choices with the principles, provide rules of thumb for achieving alignment, and give a worked case. The essay concludes by identifying support needed by researchers to act in accord with the proposed framework. (shrink)

Deliberative democracy grounds its legitimacy largely in the ability of speakers to participate on equal terms. Yet theorists and practitioners have struggled with how to establish deliberative equality in the face of stark differences of power in liberal democracies. Designers of innovative civic forums for deliberation often aim to neutralize inequities among participants through proportional inclusion of disempowered speakers and discourses. In contrast, others argue that democratic equality is best achieved when disempowered groups deliberate in their own enclaves before entering (...) the broader public sphere. Borrowing from each perspective, the authors argue that there are strong reasons to incorporate enclave deliberation among the disempowered within civic forums. They support this claim by presenting case study evidence showing that participants in such forums can gain some of the same benefits of deliberation found in more heterogeneous groups, can consider a diversity of viewpoints rather than falling into groupthink and polarization, and can persuade external stakeholders of the legitimacy of the group’s deliberations. The central project of the Critique of Pure Reason is to answer two sets of questions: What can we know and how can we know it? and What can't we know and why can't we know it? Krueger & Funder (K&F) focus on an important problem, but they offer a political rather than a scientific remedy. “Balance” is not our problem; systematic, scientific research is. Only that sort of research will ever lead social psychology out of its current malaise that focuses on positive and negative aspects of human behavior.

Professor N. G. L. Hammond has of late published some of his thoughts on the activities of Philip II in 347 and 346 B.C. In addition he has treated aspects of Philip's earlier involvement in Thessalian, Thracian, and Phokian affairs. In the process he has in many instances disagreed with a number of current findings. Among those challenged are some of mine. Healthy scholarly debate is always desirable, and in this f spirit I should welcome an opportunity to contest (...) This is the first edition in over a century to present David Hume's Enquiry concerning Human Understanding, Dissertation on the Passions, Enquiry concerning the Principles of Morals, and Natural History of Religion in the format he intended: collected together in a single volume. Hume has suffered a fate unusual among great philosophers. His principal philosophical work is no longer published in the form in which he intended it to be read. It has been divided into separate parts, only some of (...) which continue to be published. This volume repairs that neglect by presenting the four pieces that Hume in later life desired to "alone be regarded as containing [his] philosophical sentiments and principles" in the format he preferred, as a single volume with an organization that parallels that of his early Treatise of Human Nature. This edition's introduction comments on the historical origins and evolution of the four parts and draws attention to how they mutually inform and support one another. The text is based on the first (1758) edition of Hume's Essays and Treatises on Several Subjects. Notes advise the reader of the changes made in the final (1777) edition. Excerpts from the work of some of Hume's most important contemporary critics are included as appendices. Hume's abundant references to ancient historians, geographers, poets, and philosophers—many of them now quite obscure—are rendered accessible in this volume through extensive textual notes and a bibliography of online sources. This book examines the legal principle of judicial independence in comparative perspective with the goal of advancing a better understanding of the idea of an independent judiciary more generally. From an initial survey of judicial systems in different countries, it is clear that the understanding and practice of judicial independence take a variety of forms. Scholarly literature likewise provides a range of views on what judicial independence means, with scholars often advocating a preferred conception of a model court for achieving (...) 'true judicial independence' as part of a rule of law system. This book seeks to reorient the prevailing approach to the study of judicial independence by better understanding how judicial independence operates within domestic legal systems in its institutional and legal dimensions. It asks how and why different conceptualisations of judicial independence emerge over time by comparing detailed case studies of courts in two legally pluralistic states, which share inheritances of British rule and the common law. By tracing the development of judicial independence in the legal systems of Malaysia and Pakistan from the time of independence to the present, the book offers an insightful comparison of how judicial independence took shape and developed in these countries over time. From this comparison, it suggests a number of contextual factors that can be seen to play a role in the evolution of judicial independence. The study draws upon the significant divergence observed in the case studies to propose a refined understanding of the idea of an independent judiciary, termed the 'pragmatic and context-sensitive theory', which may be seen in contradistinction to a universal approach. While judicial independence responds to the core need of judges to be perceived as an impartial third party by constructing formal and informal constraints on the judge and relationships between judges and others, its meaning in a legal system is inevitably shaped by the judicial role along with other features at the domestic level. The book concludes that the adaptive and pragmatic qualities of judicial independence supply it with relevance and legitimacy within a domestic legal system. (shrink)

An edition of David Hume's _Enquiry concerning Human Understanding_ featuring an introduction to its composition and reception by Hume's contemporaries together with responses from his most significant contemporary critics: George Campbell, Thomas Reid, James Beattie, and Immanuel Kant. This edition also keeps track of the major changes Hume made to his work between the first edition of 1748 and the posthumous edition of 1777.

This paper examines the principal objections that Hume’s Scots contemporaries, George Campbell, James Beattie, and Thomas Reid raised against his views of testimony, belief, and the “theory of ideas.” In opposition to Kant’s claim that “Reid, Oswald, and Beattie” had “appealed to common sense as an oracle when insight and research [failed them]” and had “[taken] for granted what [Hume] meant to call into doubt while emphatically, and often with great indignation, demonstrating what he had never thought to question” it (...) is shown that, in each case, Hume’s critics understood him correctly and raised serious objections. But it is also shown that Hume’s work contains all the materials necessary to mount an effective response to their objections. (shrink)

This study examines whether differences in financial performance exist for investment trusts which base their portfolio selection primarily on an ethical screen, compared to indexes which incorporate a broader spectrum of investments. Results indicate that on a risk-adjusted basis there is an insignificant difference in the financial performance of these trusts against three common market benchmarks. However as to the extent of the directional effect, there does exist slightly superior financial performance by ethical trusts against their respective industry average indexes, (...) but an underperformance against a smaller company's index and the market as a whole. The lack of a distinct advantage in the short to medium term for applying an ethical screen, may in part be due to the recent development of ethical investments in Australia. Stronger performances by older ethical investment trusts may indicate superior returns are more likely to occur over a longer term. (shrink)

Two studies examined the link between social dominance and male waist-to-hip ratio (WHR). Groups of four men interacted in a leaderless group discussion. In both studies, men with higher WHRs (associated with current and long-term health status) were rated by other group members as behaving more leader-like when an observer was present, and rated themselves as being more assertive. In Study 2, men with higher WHRs were rated by independent observers as behaving more dominantly, but only when the evaluator was (...) present. These results are discussed in terms of evolutionary models of health, attraction, and intrasexual competition. (shrink)

The essays in this volume, first published in 1986, examine the philosophical foundations of social choice theory. This field, a modern and sophisticated outgrowth of welfare economics, is best known for a series of impossibility theorems, of which the first and most crucial was proved by Kenneth Arrow in 1950. That has often been taken to show the impossibility of democracy as a procedure for making collective decisions. However, this interpretation is challenged by several of the contributors here. Other central (...) issues discussed in the volume include the possibility of making interpersonal comparisons of utility, the question of whether all preferences are equally to be valued, and the normative individualism underlying the theoretical tradition. Criticisms of social choice theory are advanced and suggestions for alternative approaches are developed. (shrink)

Reid maintained that the perceptions that we obtain from the senses of smell, taste, hearing, and touch are ‘suggested’ by corresponding sensations. However, he made an exception for the sense of vision. According to Reid, our perceptions of the real figure, position, and magnitude of bodies are suggested by their visible appearances, which are not sensations but objects of perception in their own right. These visible appearances have figure, position, and magnitude, as well as ‘colour,’ and the standard view among (...) Reid scholars has been that Reid maintained that our perceptions of visible figure, position, and magnitude are also not suggested by any sensation. They are instead suggested by the material impression on the retina. Gideon Yaffe challenges the standard interpretation. According to Yaffe, Reid believed that our perceptions of visible figure are suggested by corresponding sensations, by sensations of colour. We defend the standard interpretation of Reid. According to Reid, there is no “local sign” in our sensations of colour. The same colour sensation can be associated with different positions on the visual field, and different colour sensations can be associated to the same position on the visual field. According to Reid, we only have evidence for a correlation between the image on the retina and the perception of visible figure. (shrink)

Today a variety of theological approaches offer fresh and enriching insights, yet much of contemporary religious thought can be disorienting for the beginning student of theology. This accessible introduction presents aspects of the thought of Fr. Bernard Lonergan SJ, (1904–1984) in a way that makes his vital contribution to contemporary theology accessible to the beginning student. The author minimizes technical terms and explains basic ideas with user-friendly examples. Rather than a survey of diverse contemporary theological opinions, or a thematic presentation (...) of one topic, the book tries to clear away confusions by focusing on the theologian concerned with those topics. The book will thus encourage creative ways of overcoming some of the unnecessary obstacles for students who want to explore theology today. (shrink)
